Background of the Case and Investigation

This is a class action where Plaintiff Samuel Rubio (“Plaintiff”) seeks collective and class statuts of non-exempt Technical Consultants who repair phones and other equipment and were required by Defendant Sprint Communications Company LP and Sprint/United Management Co. ("Sprint" or "Defendants") to work off the clock and through required meal and rest periods and  incur business expenses without reimbursement. 


Defendant operates retail and repair stores in California.  Plaintiff has worked with Sprint since February 2011 and works in Los Angeles County.   This action was filed in the Los Angeles Superior Court, Civil Complex Center on December 9, 2016. 

Plaintiff’s Class Action Complaint asserts the following causes of action:

1. FAILURE TO PAY WAGES UNDER THE FLSA [29 USC §§ 206, 207];
2. FAILURE TO PROVIDE MEAL PERIODS
3. FAILURE TO PROVIDE REST PERIODS;
4. FAILURE TO PAY WAGES AND RELATED OVERTIME COMPENSATION;
5. FAILURE TO PROVIDE REIMBURSEMENT FOR BUSINESS EXPENSES;
6. FAILURE TO PROVIDE PROPER ITEMIZED STATEMENTS;
7. FAILURE TO PAY WAGES DUE AND PAYABLE TWICE MONTHLY;
8. FAILURE TO PAY ALL WAGES DUE UPON ENDING OF EMPLOYMENT; and 
9. UNLAWFUL COMPETITION AND UNLAWFUL BUSINESS PRACTICES.  

Investigation and Counsel Involved
